LikeStream Privacy Statement

PRIVACY STATEMENT

1.    Acknowledgment and acceptance of terms

We are committed to protecting your privacy. This Privacy Statement sets forth our current privacy practices with regard to the information we collect when you or your computer interact with LikeStream LLC’s websites and applications, including LikeStream Facebook application and www.likestream.net  (each a “Site and collectively “Sites”). By accessing our Sites, you acknowledge and fully understand this Privacy Statement ("Statement"), agree to be bound by the terms contained in this Statement, and freely consent to the information collection and use practices described in this Statement. You further acknowledge and agree that you are at least 13 years old. If you are under 13 years old, you do not have permission to access this site.

If you do not agree to these terms, please do not access or use this site.

2.    Participating Third Party Policies

The Site may contain links to related services and offerings, including vendor sites. These third parties may have their own privacy statements that can be viewed on their websites or by contacting these third parties directly. These third parties who participate in our services are encouraged to participate in industry privacy initiatives and to take a responsible attitude towards consumer privacy. However, since we do not have direct control over the policies or practices of third parties, we are not responsible for the privacy practices or contents of those sites. We recommend and encourage that you always review the privacy policies of these third parties before you provide any personal information or complete any transaction with such parties.

3. Collection and Use of Personal Information
We collect certain information from and about our users three ways: (1) directly from our web Server logs, (2) with Cookies, and (3) from you, the user. We do not collect information about the specifics of who you are ("Personally Identifiable Information") unless you specifically provide it to us.

a. Web Server Logs

When you visit our Site, we may track information to administer the Site and analyze its usage. None of this information is Personally Identifiable Information. Examples of information we may track include, but are not limited to:
  • Your Internet protocol address
  • The kind of browser or computer you use
  • Number of links you click within the site
  • State or country from which you access the site
  • Date and time of your visit
  • Name of your Internet service provider
  • Web pages from which you link to our site
  • Web pages you go to from our site
  • Pages you view on our site

b. Use of Cookies

We use cookies to personalize or enhance your user experience. A cookie is a small text file that is placed on your hard disk by a web page server. Cookies cannot be used to run programs or deliver viruses to your computer. Cookies are uniquely assigned to you, and can only be read by a web server in the domain that issued the cookie to you.

One of the primary purposes of cookies is to provide a convenience feature to save you time. For example, if you personalize a web page, or navigate within a site, a cookie helps the site to recall your specific information on subsequent visits. Hence, this simplifies the process of delivering relevant content and eases site navigation by providing and saving your preferences and log in information as well as providing personalized functionality.

The type of information that may be stored in a cookie includes non-Personally Identifiable Information about you, such as a randomly assigned user or session identification number, the country where you are located, and your first name to welcome you back to the site.

If your browser is set to reject cookies, you may not be able to log in to the site and hold an account. This means you will not be able to provide and receive comments and ratings.

Some of our business partners may use cookies on our site. However, we have no access to or control over these cookies, once we have given permission for them to set cookies for processing your information.

c. Personal Information entered by users

We are the sole owner of the personal information collected on our Sites. We will not sell, share, or rent this information to others in ways different from what is disclosed in this Statement.

We ask for certain personal information in order to provide you with a personalized experience. For example, on the LikeStream Facebook application we collect the ratings you create for businesses such as restaurants. We also collect your zip code or other location information in order to provide you with information regarding your local area. At any point you can view and edit this personal information under the “Settings” section of the Site.

We require the following information for basic registration at our Site:
  • Your Facebook profile information and other details as made available via your public Facebook profile or via explicit Facebook-provided permission dialogs (“Public Profile”)
  • Your email address
  • Your geographic location.
In addition, you are invited to "opt in" to receive a regular newsletter or occasional email from our Sites, and you are free to opt out from either of these services at any point in the future.  You may also provide information for your Public Profile to introduce yourself to other members of our Sites, including the information listed above, or other information, but are under no obligation to do so.  You have the option of providing more private information to personalize your experience.

The information you provide is subject to the following:
  • The LikeStream Facebook application will be sending your ratings and comments to the LikeStream servers to improve the recommendations we provide to you within the application
  • This data will be saved by LikeStream in our databases
  • Your ratings and comments will not be visible to any other parties except those who you have already “friended” on Facebook and as such have already gained access to your profile information and other details
  • Your full name can be used to personalize the email messages that are sent on your behalf when you invite friends to the service, and may also be used (at your option) by friends who are searching for your profile
  • From time to time we will invite users who have distinguished themselves by their expertise or recommendations to become “Experts”. If you receive and accept such an invitation, you will be required to permit us to make your ratings and comments visible to all users. Of course, you may choose to decline such an invitation
We will not sell, trade, or rent Personally Identifiable Information to others. Furthermore, we will not disclose Personally Identifiable Information we collect from you to third parties without your permission, except to the extent necessary:
  • To fulfill your service request
  • To protect ourselves from liability
  • To respond to a court order or subpoena, to comply with an investigation, or to comply with applicable laws or rules, or
  •  In connection with a merger, acquisition, or liquidation of the company
We reserve the right to report to law enforcement agencies any activities that we in good faith believe to be unlawful.

For terms relating to areas of this Site that allow you to communicate and/or submit information on or through the Site, such as bulletin board postings, e-mail, messages, suggestions, ideas, fictional work, non-fiction material, photographs, drawings, or concepts, please refer to our terms of use.

4.    Use of Web Beacons or GIF files

We reserve the right to include on our Site electronic images known as web beacons sometimes also called single-pixel gifs that allow us to count users who have visited those pages and to deliver co-branded services. We reserve the right to include web beacons in promotional e-mail messages or newsletters in order to determine whether messages have been opened and acted upon.

If included on our site, web beacons may be placed by third party service providers to help determine the effectiveness of our advertising campaigns or e-mail communications. You should visit those service provider's web pages to review their privacy policies; see paragraph 2 above. We prohibit web beacons from being used by third parties to collect or access your Personally Identifiable Information.

5.    Accessing Web Account Information

We will provide you with the means to ensure that Personally Identifiable Information that we have on file for you is correct and current. You must update your Personally Identifiable Information promptly after it changes. You may review this information by sending us an e-mail. You may ask to have the information on your account deleted or removed at any time. We will use reasonable efforts to delete your information; however, because we and our web hosting company have backup systems and keep track of past transactions and/or activities, it may be impossible to completely delete your information.

6.    User Communication

We may, from time to time, send you e-mail regarding our services. In addition, if you indicate upon registration that you are interested in receiving offers or information from us, we may occasionally send you direct mail about products and services that may be of interest to you. If you do not want these mailings, you can tell us when you submit or edit your Personally Identifiable Information.

7.    Security of Information

We will keep your Personally Identifiable Information secure consistent with current industry standards. Security of your Personally Identifiable Information is of utmost concern to us. Personally Identifiable Information, once transmitted to us, will be stored on computers that only selected personnel and contractors have access to via password, and/or on web hosting servers owned and maintained by us within Silicon Valley Colocation which employs its own physical and network security measures. 8. Sharing of Information


We will share user profile and demographic information with our partners and advertisers, for purposes including, but not limited to, the delivery of targeted advertising. This information will not be linked to any Personally Identifiable Information.We may use third-party advertising companies to serve ads when you visit our Sites. These companies may use information (not including your name, address, email address, or telephone number) about your visits to this and other websites in order to provide advertisements about goods and services of interest to you. In particular, Facebook and Google, as third party vendors, use cookies when serving ads on our Sites. These cookies enable them to serve ads based on what sites you visit across the Internet, whether it's to show targeted ads when you visit our Sites, or to show restaurant-related ads when you visit other websites. You may opt out of the use of Google's "DART" cookie by visiting the Google ad and content network privacy policy

9.    Surveys and Contests

Periodically, we may request information from users via surveys or contests. Participation in these surveys or contests is completely voluntary and the user therefore has a choice whether or not to disclose this information. Information requested may include contact information (such as name, telephone number and shipping address). Contact information (including telephone number and address) will be used to notify the winners and award prizes and by giving us your phone number you acknowledge and agree that we may contact you by telephone in connection with such survey or contest. Survey information will be used for purposes of monitoring or improving the use and satisfaction of this site. We sometimes partner with third parties to implement our surveys and contests. Personally Identifiable Information may be initially received by and passed on to us by such third parties.

10.Inviting Friends

If a user elects to use our referral service for informing a friend about our Site, we ask them for the friend’s name and email address. We will automatically send the friend a one-time email invitation to visit the Site, and may send one follow-up invitation to friends that did not respond. We store this information for the sole purpose of sending these emails. The friend may contact us at privacy at likestream dot net to request the removal of this information from our database.

11.Changes to this Statement

We have the discretion to update this Statement at any time. When we do, we will also revise the updated date at the bottom of this Privacy page and may notify users by email. We encourage you to periodically review this Statement to stay informed about how we are helping to protect the personal information we collect. You acknowledge and agree that it is your responsibility to review this Statement periodically and become aware of modifications. Your continued use of this site constitutes your agreement to this Statement and any updates.

12.“Beta” Disclaimer

Our Sites are (currently) “Beta” software. While we strive to maintain all of the above privacy precautions, our Sites are not devoid of risk of “bugs” and software faultiness that is common with Beta software. As stated in our Terms of Service, we disclaim and limit our liability with respect to such “Beta” software, including limitations on any liability regarding privacy issues set forth in this Statement.

13.Conflict with Terms of Service

In the event of a conflict between this Statement and our Terms of Service, the Terms of Service shall control.
